Law Enforcement Training Practices
A training program is only as defensible as its underlying methodology.
I evaluate how an agency designs, delivers, and documents its curriculum. Adult Learning Theory is the yardstick. As Louisiana's Senior Master Instructor, every piece of instructor curriculum in the state passes through me before I present it to the POST Council for legislative approval. That is the same lens I bring to a failure-to-train claim.
How I Review a Case
A training claim lives or dies in the paperwork. I ask for lesson plans, instructor certifications, attendance rosters, testing records, and the curriculum the agency was running at the time. State POST records tell me what was required. The agency's own files tell me what was delivered. I compare those two, then look at whether the instruction was built to change how officers perform or just to fill a mandated hour count.
What an Engagement Produces
I can usually tell you early whether a failure to train theory has legs. That assessment is short, so it is worth doing first. When the record supports a full opinion, I produce a written Rule 26 report covering program design, documentation, and the adequacy of what the agency taught. I also review opposing expert reports, give deposition testimony, and testify at trial.
